Terms of Service & Rental Agreement

These Terms of Service and Rental Agreement ("Agreement") govern your use of the Road Vision Auto Rentals website, apps, and vehicles ("Services"). By creating an account, booking a vehicle, or taking possession of a rental, you agree to be bound by this Agreement. If you do not agree, do not use the Services.

1. Driver Eligibility

• You must be at least 21 years old (25 for premium and luxury categories).
• You must hold a valid, unexpired driver's license issued at least 12 months prior to pickup.
• International renters must present a valid passport and, where required, an International Driving Permit.
• You must not have any DUI, reckless-driving, or license suspension within the last 36 months.
• Only drivers listed on the rental contract may operate the vehicle. Additional drivers must be verified in advance.

2. Reservations, Deposits & Payment

• A 20% non-refundable deposit is charged at booking to secure the vehicle.
• The remaining balance is due at pickup via the payment method on file.
• A refundable security hold may be authorized on your card at pickup to cover fuel, tolls, damage, or fines.
• Prices, taxes, and fees are shown in USD unless otherwise stated and may change until checkout is completed.

3. Identity & Insurance Verification

You must pass driver's license verification and either present proof of qualifying personal auto insurance or accept one of our optional insurance products. We may refuse or cancel a rental if verification fails or documents cannot be validated.

4. Use of the Vehicle

You agree that the vehicle will NOT be used:

• By anyone under the influence of alcohol, drugs, or controlled substances.
• For any illegal purpose, including transporting contraband or unauthorized passengers.
• For racing, off-roading, towing, or commercial deliveries (unless expressly authorized in writing).
• Outside the geographic area authorized on the rental contract without prior approval.
• To transport more passengers than seat belts allow, or with pets outside of pet-friendly vehicles.
• By smokers — a $250 cleaning fee applies to any vehicle returned with tobacco, cannabis, or vape residue.

5. Fuel, Tolls & Cleaning

Vehicles are supplied with a full tank and must be returned full. Refueling by Road Vision is billed at market rate plus a $15 service fee. Unpaid tolls, parking tickets, and traffic citations incurred during your rental are your responsibility and will be billed to your card along with a $35 administrative fee per incident. Excessive interior soiling is billed at cost up to $150.

6. Damage, Loss & Liability

You are responsible for all loss or damage to the vehicle during the rental period, up to its fair market value, plus loss of use, towing, and administrative charges — reduced by any insurance you have purchased or provided. You must report accidents, theft, or vandalism to Road Vision and to local police within 24 hours. Failure to report voids optional insurance coverage.

7. Late Returns & Extensions

Vehicles must be returned by the agreed date and time. Late returns are billed at 1.5x the daily rate per hour, capped at one full additional day. Extensions must be requested and approved in advance and are subject to availability and pricing.

8. Cancellations & Refunds

Cancellations are governed by our Cancellation & Refund Policy, which is incorporated into this Agreement by reference.

9. Prohibited Conduct

You may not attempt to disable telematics, GPS, or safety systems; sublease the vehicle; misrepresent your identity; or use the Services to violate any law. We may terminate your account and rental immediately for any violation.

10. Disclaimers

THE SERVICES AND VEHICLES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAD VISION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAD VISION'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNTS YOU PAID FOR THE RENTAL GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Road Vision, its affiliates, and their officers and employees from any claim, damage, or expense arising from your use of the vehicle or breach of this Agreement.

13. Governing Law & Disputes

This Agreement is governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute shall be resolved by binding arbitration on an individual basis, except that either party may seek injunctive relief in court for intellectual-property or unauthorized-use claims. YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

14. Changes

We may update this Agreement from time to time. Material changes will be posted here with an updated date. Continued use of the Services means you accept the updated terms.
